Terms
Terms and conditions
Submitting a reservation, online or by phone, accepts these terms. They are written to be read in one sitting.
1. The agreement
A reservation is a contract between the person or account named on it and BlackCarLivery.Services for the chauffeured transportation described in the confirmation. The confirmation, the payments page and the cancellation policy form part of these terms.
2. Fares
Transfer fares are fixed for the journey described and include the items listed on the payments page. Hourly bookings are charged for the hours reserved plus any extension requested on the day, in fifteen-minute steps. Additional stops, route changes or passengers added on the day are charged only where they change the journey materially, and the chauffeur or the desk will say so before proceeding. Ontario HST applies.
3. Minimums
Hourly bookings carry a three-hour minimum for sedans and SUVs and a five-hour minimum for Sprinters and stretch limousines. Garage-to-pickup and drop-to-garage time is charged for Sprinters and stretch limousines only, and appears on the quote.
4. Waiting
Airport pickups include sixty minutes of waiting after a domestic landing and ninety after an international one, measured from the aircraft landing. Address pickups include fifteen minutes. Beyond those windows, waiting is charged at the hourly rate for the vehicle in fifteen-minute steps.
5. Passengers and conduct
The vehicle may carry no more passengers than it has seat belts. Smoking and vaping are prohibited in every vehicle. Open alcohol is permitted only in the stretch limousine and in partitioned Sprinters, for passengers of legal age, in accordance with Ontario law. Illegal substances, weapons and conduct that endangers the chauffeur or others end the journey without refund. Damage or soiling beyond normal use is charged at the cost of repair or detailing, with a minimum detailing charge of $250.
6. Children
Children under eight must travel in an appropriate child seat as required by Ontario law. Seats are provided at no charge when requested at booking. The chauffeur will not depart without one fitted.
7. Luggage
Luggage capacity is stated for each vehicle class on the fleet page. Luggage beyond that capacity may require a larger vehicle at the applicable fare. We are not liable for items left in vehicles, but the desk will make every effort to return them.
8. Delays and liability
We undertake to arrive on time and to use the best route available. We are not liable for delays caused by traffic, weather, road closures, border processing, accidents or other events outside our control, nor for consequential losses such as missed flights or events arising from them. Our maximum liability for any booking is the fare paid for it. Passengers are carried under commercial passenger insurance as required by the City of Toronto vehicle-for-hire bylaw.
9. Cross-border travel
Passengers are responsible for holding the documents required to enter the United States and to return to Canada. Refusal of entry does not entitle a refund. Border processing time counts toward hourly bookings.
10. Affiliate bookings
Journeys outside the area served by our own fleet are performed by affiliate operators selected from the Limousine Association International network. We remain your contracting party for booking, payment and support. The affiliate's vehicle and chauffeur are subject to the licensing of their own jurisdiction.
11. Substitution
Where the reserved vehicle is unavailable through breakdown or accident, we supply a vehicle of the same or a higher class at no additional charge. Where only a smaller vehicle is available and you accept it, the fare is reduced accordingly.
12. Privacy
Personal information is handled as described in the privacy policy.
13. Governing law
These terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario. Disputes are subject to the courts of Ontario.
